Right, but you’ve always been able to legally modify a 3DS. Now, they won’t push out an update to prevent that if that’s what you mean.

No? I can modify my switch if I want to and Nintendo can’t do anything about it legally. If I buy something, how is it illegal to modify? If I break EULA laws with my modifications then it’s illegal.
Nintendo doesn’t like it, but legally speaking, they can’t do anything about it, unless I were to download illegal material or a game without purchasing the license first.
