tModLoader copyright question

hello, I have one question and it is do I still have to have permission to kind of copy a boss from a very old mod like Avalon.

Yes, you always should ask for permission if it is a copy. Maybe not if it's your own unique version with your own sprite and ai. But you really shouldn't be copying anyways since Avalon is being remade for tmodloader.
